These terms and conditions (the "Terms and Conditions") govern the use of www.eqk9training.com (the "Site"). This Site is owned and operated by EQ K9 Training. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

Intellectual Property
All content published and made available on our Site is the property of EQ K9 Training and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Acceptable Use
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:

  • Violate the intellectual property rights of the Site owners or any third party to the Site;

  • Hack into the account of another user of the Site; or

  • Act in any way that could be considered fraudulent.

If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

Accounts
When you create an account on our Site, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account; and

  2. All personal information you provide to us through your account is up to date, accurate, and truthful and that you will update your personal information if it changes.

We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

Sale of Goods And Services
These Terms and Conditions govern the sale of goods and services available on our Site.

The following goods are available on our Site:

  • Dog toys and dog training equipment, dog equipment.

We are under a legal duty to supply goods that match the description of the good(s) you order on our Site.

The following services are available on our Site:

  • Dog training;

  • Dog walking; and

  • Dog boarding.

The services will be paid for in full when the services are ordered.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

Third Party Goods and Services
Our Site may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

Subscriptions
Your subscription automatically renews and you will be automatically billed until we receive a notification that you want to cancel the subscription.

To cancel your subscription, please follow these steps: If you wish to cancel at any time, you must give us 1 week/month's notice and continue your weekly/monthly payments up until the expiry of the notice period.

Free Trial
We offer the following free trial of our goods and services: A 14-day free trial begins when users register for a new account. The free trial includes unlimited access to all documents available on our site.

At the end of your free trial, the following will occur: You will automatically be billed our weekly/monthly subscription rate. If you do not want to be billed, you will need to cancel your subscription before your free trial ends.

To cancel your free trial, please follow these steps: Log in to your account and select "Cancel Free Trial" under the "Account Management" tab.

Payments
We accept the following payment methods on our Site:

  • Credit Card;

  • PayPal;

  • Debit;

  • Klarna; and

  • Cash.

When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.

If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered through one of the following methods:

  • Standard delivery by post. Delivery takes 3 - 7 business days.

Delivery will take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and bank holidays.

You will be required to pay delivery charges in addition to the price for the goods you purchase.

You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Right to Cancel and Receive Reimbursement
If you are a customer living in the United Kingdom or the European Union you have the right to cancel your contract to purchase goods and services from us within 14 days without giving notice. The cancellation period:

  • Will end 14 days from the date of purchase when you purchased digital content that was not supplied on a tangible medium;

  • Will end 14 days from the date of purchase when you purchased a service;

  • Will end 14 days from when you receive, or someone you nominate receives, the goods when you purchased good(s) in one order that are all delivered together;

  • Will end 14 days from when you receive, or someone you nominate receives, the last good when you purchased goods in one order that are delivered separately; or

  • Will end 14 days from when you receive, or someone you nominate receives, the first good when you purchased goods that will be regularly delivered during a defined period of time.

To exercise your right to cancel you must inform us of your decision to cancel within the cancellation period. To cancel, contact us by email at info@eqk9training.com or by post at __________. You may use a copy of the Cancellation Form, found at the end of these Terms and Conditions, but you are not required to do so.

Effects of Cancellation
If you cancel your contract with us and goods have already been sent to you, then you must return the goods to us as soon as possible after informing us of your decision to cancel. You will be responsible for the cost of returning the goods. We will not be responsible for any damage or loss to the goods that occurs before they are returned to us, including while the goods are in transit.

If you cancel your contract with us, we will reimburse you all payments we received from you under the contract, including the costs of delivery, except for any supplementary delivery charges resulting from your choice of a delivery type other than the least expensive type of standard delivery that we offer. Please note that we are permitted by law to reduce your reimbursement to reflect any reduction in the value of the goods that was caused by handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

We will provide the reimbursement without undue delay and no later than the earlier of 14 days after we receive back from you any goods supplied or 14 days after you provide proof that you have returned the goods. If no goods were supplied, then we will provide the reimbursement no later than 14 days after the day we were informed of your decision to cancel.

If you requested the performance of services begin during the cancellation period, you are required to pay us an amount which is in proportion to what has been performed until you have communicated to us your decision to cancel this contract. We will reimburse you any amount you have paid above this proportionate payment.

If you provide express consent to the supply of digital content during the cancellation period and acknowledge that your right to cancel the contract is lost by the supply of digital content during the cancellation period, you will no longer have a right to cancel the contract.

We will make the reimbursement using the same form of payment as you used for the initial purchase unless you have expressly agreed otherwise. You will not incur any fees because of the reimbursement.

This right to cancel and reimbursement is not affected by any return or refund policy we may have.

Refunds
Refunds for Goods
Refund requests must be made within 14 days after receipt of your goods.

We accept refund requests for goods sold on our Site for any of the following reasons:

  • Good is broken;

  • Good does not match description; or

  • Good is the wrong size.

Refunds do not apply to the following goods:

  • any item that has been used can not be returned.; and

  • sale items.

Refunds for Services
We provide refunds for services sold on our Site as follows:

  • The services will be fully refunded if the services are cancelled at least 24 hours before the services were scheduled to be provided.
    If you wish to cancel your service after the start date, we will calculate the sessions you had and the remaining will be refunded. we do not accept any responsibility if you did not receive the result once you cancel your service before the end date of the course. We do not offer refunds for any session you had with us, regardless of the results.

Returns
Returns can be made by mail. To return a good by mail, follow the following procedure:
please return the goods in their original package, pack your items and attach the return label that was included in your package. go to your nearest post office and return it.

Consumer Protection Law
Where the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Links to Other Websites
Our Site contains links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third-party websites before using these sites.

Limitation of Liability
EQ K9 Training and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless EQ K9 Training and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law
These Terms and Conditions are governed by the laws of the Country of England.

Additional Terms

  • Nothing in this agreement and nothing in our statements to you will be construed as a promise or guarantee about the outcome of your matter. We make no such promises or guarantees. Our comments about the outcome of your matter are expressions of opinion only.

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Classes and Sessions: 

By registering for any group classes you will agree that we do not take any responsibility for any injury or problem, or issues that may happen to you or to your dog. 

You must clean up after your dog.

Payment

all the payments and bookings have to be through the website/bank transfer/cash unless otherwise agreed between us and the client.

if the client wants to pay by cash they have to pay the full amount on or before the first session.

If the client wants to pay by bank transfer, the full amount must be paid before the initial session.

Once you submit the registration form, you agreed to pay any balance you owe us.

Deposits for the bookings will be deducted from the full amount of each package you booked.

we will invoice you for any session/package you book with us.

 

Group classes

EQ K9 Training reserves the right to amend the group classes at any time for any reason, no money will be refunded after the group classes start, so if you would like to opt out of the classes you must notify the Trainer before the first session.

EQ K9 Training may change the places or the times for any week, therefore participants will be notified by email.

you are only eligible for a refund if you opt out before the starting date of the class you registered for.

Klarna

Pay in 3 instalments or pay in 30 days

 

What is Pay in 3?

·        Pay in 3 allows you to spread the cost of your purchase over 3 equal payments. The payment for each instalment will automatically be collected from the debit or credit card entered at checkout. Your first installment will be collected when your order is confirmed and instalments 2 and 3 are scheduled 30 and 60 days later, respectively.

What is Pay in 30 days?

·        Klarna gives you the chance to try before you buy. Once your order is confirmed, you'll receive an email with payment instructions within two days from Klarna. You'll then have 30 days to try on your order and only pay when you’re happy. Complete the payment online, at your convenience, with no extra cost. You can pay via credit or debit card in Klarna. app or by logging into www.klarna.com/uk.

Am I eligible for Klarna?

·        To use Pay later in 30 days you must be at least 18. Whilst this option is widely promoted, Pay later in 30 days is subject to your financial circumstances. When choosing Pay later in 30 days, our assessment will not affect your credit rating.

What do you need to provide when making a purchase using Klarna?

·        You will need to provide your mobile phone number, email address, current billing address and a debit or credit card. The mobile number is required in case Klarna needs to reach you regarding payment. Klarna will send all other communications to you via your email address. It is important that you provide your correct details at checkout, otherwise, you will not receive your payment schedule and any updated order information.

·        Payment information is processed securely by Klarna. No card details are transferred to or held by EQ K9 Training. All transactions take place via connections secured with the latest industry standard security protocols.

·        In order to be able to offer you Klarna’s payment options, we will pass to Klarna certain aspects of your personal information, such as contact and order details, in order for Klarna to assess whether you qualify for their payment options and to tailor the payment options for you. General information on Klarna you can find here. Your personal data is handled in accordance with applicable data protection law and in accordance with the information in Klarna’s privacy policy.

Cancellation Policy and Refunds

If the client chooses the bank transfer method for payment in the registration form, payment has to be made before or at the first session date. if the client chooses the cash payment, the client has to pay the full amount at the first session. any delay leads to cancelling the remaining sessions and the client has 30 days to make the payment, if the client decides to not make the payment we will be taking legal action. we may send the client several email reminders for the payment before cancelling the package.


Cancellations made 1 day or more in advance of the [Appointment/Service/Event] date will receive a 100% refund. Cancellations made within 24 hours will not receive a refund.
If you cancel without any notice on the day of the appointment/service/event you will be charged the full amount for the session and the rest of your money will be refunded (depending on the remaining sessions).

No refund will be made unless agreed between the trainer and the client. no refund will be made after the session. you are entitled to a refund only if we are not able to train your dog or meet your requirements, when you make payment by PayPal please confirm that you received the service, we may send you an email for approval.

If you register with us through phone/E-mail/WhatsApp or other third parties you agreed to our terms and conditions by sending back our registration form, you will need to pay for the package you have chosen by cash or bank transfer in full before or on the first session, unless you cancel 1 day prior to your chosen date. 

EQ K9 Training will not accept any responsibility for your booking. if the booking hasn’t been paid for, your booking will be cancelled if you don't pay in full 1 day prior to your booking.

Congestion Zone ( Central London ):

If you live in the congestion charge zone, the rate will apply if you live in the congestion charge zone, you will be invoiced separately for the congestion rate.

Data protection

We are registered with the ICO ( Information Commissioner’s Office ) for GDPR, please visit the ICO website for further information.

Cancellation and amendments 

EQ K9 TRAINING reserves the right to amend all its sessions such as changing the date and cancelling for any reason with previous notice through text or email. If the client registers and pays for any training package and decides/feels/thinks the training they received was enough and no longer wishes to continue with the package, all the sessions they had will be calculated as a single session and the client will be charged £100 per session.

 

Recording

Training sessions may be recorded for monitoring, advertising, and training purposes.
